MetroSkiRentals — Rental Liability Waiver & Release of Claims (v1)
In consideration of being permitted to rent and operate a personal watercraft ("PWC" or "jetski") from MetroSkiRentals, the undersigned ("Renter") agrees to the following:
1. ASSUMPTION OF RISK. Renter acknowledges that operating a jetski involves inherent risks including but not limited to collision, capsizing, drowning, mechanical failure, weather, wake, and the actions of other vessels. Renter voluntarily assumes all such risks.
2. RELEASE. Renter, on behalf of themselves, their heirs and assigns, releases and forever discharges MetroSkiRentals, its owners, employees and agents from any and all claims, demands, or causes of action arising out of the rental or use of the equipment, except for gross negligence or willful misconduct.
3. OPERATOR REQUIREMENTS. Renter certifies they are at least 18 years old, hold any boater safety certification required by Michigan law, and are not under the influence of alcohol or drugs.
4. EQUIPMENT. Renter agrees to wear a U.S. Coast Guard-approved life jacket at all times while on the water, follow all posted lake rules and Michigan boating laws, and operate the jetski responsibly.
5. DAMAGE / LOSS. Renter is responsible for any damage to the jetski, trailer or accessories caused by negligence, misuse, or operation outside agreed terms, up to the full replacement value.
6. RETURN. Renter agrees to return the equipment at the agreed time. Late returns may incur additional hourly charges.
By signing below, Renter confirms they have read, understood, and agree to be bound by this Waiver.
